Liability and Compensation for ship-source Pollution

The Regional Organization for the Conservation of the Environment of the Red Sea and Gulf of Aden (PERSGA) in cooperation with the International Oil Pollution Compensation Fund (IOPC Fund), and the International Group of P&I Associations (IG), held a three day virtual regional workshop on Liability and Compensation under the HNS, CLC, Bunker and IOPC Fund Conventions.

The workshop was held between September 13-15, 2021 by videoconference and hosted by PERSGA. Delegates from each of the PERSGA States were invited to attend and a total of 35 delegates attended the three day virtual workshop. The training workshop was dedicated to promoting the implementation of international oil pollution compensation instruments including the 1992 Civil Liability Convention, 1992 Fund Convention, 2003 Supplementary Fund Protocol, and Bunker Convention in the Red Sea and Gulf of Aden Region. An additional objective was to recommend to PERSGA countries, where appropriate, to accede to Funds Convention, its related Protocols and the 2010 HNS Convention.

The five representatives made presentations on a diverse range of subjects covering the range of liability regimes for maritime incidents. Subjects covered included the international regime on oil pollution from tankers (CLC 1992 and 1992 Fund Convention), the 2001 Bunkers Convention,  the Limitation of Liability of Maritime Claims Conventions (1976 and 1996), and the 2010 Hazardous and Noxious Substances Convention.

The audience also undertook a practical online exercise involving a theoretical tanker and bunker oil incident and also learned about the types of claims covered under the various liability regimes, and the criteria applied in order to make successful claims under the various regimes.

The workshop was given mainly in English.  At the end, PERSGA provided all relevant documents of the training workshop to all the participants. Based on the results of the course evaluation questionnaire, the regional virtual training workshop was highly successful and met its overall objectives.
